FAIRCLOSE, a Delaware limited liability company ("Company" or "We") respects your privacy and is committed to protecting it through our compliance with this Privacy Policy.

This Privacy Policy describes the types of information that we may collect from you or that you may provide when you visit our website www.fairclose.com (our "Site") and use our software platform (“Platform”) and sets forth our practices for collecting, using, maintaining, protecting, and disclosing that information.

This Privacy Policy applies to information that we may collect:

  • On our Site.
  • In email, text, and other electronic messages between you and this Site.
  • Through mobile and desktop applications you download from this Site or our Platform, which provide dedicated non-browser-based interaction between you and this Site.
  • When you interact with our advertising and applications on third-party websites and services, if those applications or advertising include links to this policy.
  • From you through your use of our Site and Platform to engage in transactions, including information that you provide to us verifying your ownership of real property, your past real estate sale or purchase transactions, your creditworthiness to enter into transactions involving the purchase of real property, your proof of availability of funds to close a transaction, or your proof of funding approval.

  • Us offline or through any other means, including on any other website operated by Company or any third party, including our affiliates and subsidiaries; or
  • Any third party, including our affiliates and subsidiaries, including through any application or content, including advertising, that may link to or be accessible from or on the Site or Platform; or

INFORMATION WE COLLECT ABOUT YOU AND HOW WE COLLECT IT

We may collect several types of information from and about users of our Site, including information:

Your User Contributions are posted on and transmitted to others at your own risk. Although we may limit access to certain pages, and you may set certain privacy settings for such information by logging into your Account profile, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Site with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

We may use the information and/or data that we have collected from you to enable us to display advertisements to our advertisers' target audiences. LOCATION OF PERSONAL INFORMATION

We use Amazon Web Services to support the FAIRCHOICE Site and Platform.  Amazon Web Services, Inc. is located in the United States, and has affiliated companies are located throughout the world. Depending on the scope of your interactions with our Site and Platform and Amazon Wed Services (“AWS”) Offerings, your personal information may be stored in or accessed from multiple countries, including the United States. Whenever your personal information is transferred to other jurisdictions, AWS will ensure that the information is transferred in accordance with the AWS Privacy Policy (which can be found at https://aws.amazon.com/privacy) and as permitted by applicable data protection laws.

 

HOW WE SECURE INFORMATION

Security is one of our highest priorities. We have designed our systems and retained the services of AWS with your security and privacy in mind.

AWS maintains a wide variety of compliance programs that validate the AWS security controls. The AWS compliance programs can be found at https://aws.amazon.com/compliance/programs.  AWS protects the security of your information during transmission to or from AWS websites, applications, products, or services by using encryption protocols and software. We and AWS follow the Payment Card Industry Data Security Standard (PCI DSS) when handling credit card data. We and AWS maintain physical, electronic, and procedural safeguards in connection with the collection, storage, and disclosure of personal information. Our security procedures mean that we may request proof of identity before we disclose personal information to you.

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Site or Platform, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Site like message boards and information that you may  upload or share to our Site and Platform have about third parties (such as your contacts). The information you share in public areas may be viewed by any user of the Site.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Site or Platform. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Site or Platform.

DISCLOSURE OF INFORMATION

We may disclose aggregated information about our Users, and information that does not identify any individual, without restriction.

We contractually require these third parties to keep personal information confidential and use it only for the purposes for which we disclose it to them. We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:

  • Targeted Advertising. We do not control third parties' collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. ACCESSING AND CORRECTING YOUR INFORMATION

You can review and change your personal information by logging into the Site and visiting your Account profile page.  You may also send us an email at [email protected] to request access to, correct or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user Account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

Deletion of Your Account.  If you delete your user Account, any uploads, links or the contributions that you have made to our Site or Platform may remain viewable in cached and archived pages or might have been copied or stored by other Site and Platform users. Proper access and use of information provided on the Site and Platform is governed by our Terms of Service and Use.

Right to be Forgotten. You have the right to request that we delete all of your personal information. We cannot delete your personal information except by also deleting your User account, and we will only delete your account when you have requested that we do so. We may not accommodate a request to erase information if we believe the deletion would violate any law or legal requirement or cause the information to be incorrect. In all other cases, we will retain your personal information as set forth in this Policy. In addition, we cannot completely delete your personal information as some data may rest in previous backups. These will be retained for the periods set forth in our disaster recovery policies.

You have the right to lodge a complaint with the applicable supervisory authority in the country you live in, the country you work in, or the country where you believe your rights under applicable data protection laws have been violated. However, before doing so, we request that you contact us directly in order to give us an opportunity to work directly with you to resolve any concerns about your privacy.

If you contact us to exercise any of the foregoing rights, we may ask you for additional information to verify your identity. We reserve the right to limit or deny your request if you have failed to provide sufficient information to verify your identity or to satisfy our legal and business requirements. DO NOT TRACK SIGNALS

We may use automated data collection technologies to track you across websites. We currently do not honor do-not-track signals that may be sent by some browsers.

We also may use automated data collection technologies to collect information about your online activities over time and across third-party websites or other online services (behavioral tracking). Some web browsers permit you to broadcast a signal to websites and online services indicating a preference that they “do not track” your online activities. At this time, we do not honor such signals and we do not modify what information we collect or how we use that information based upon whether such a signal is broadcast or received by us.

GDPR WEBSITE PRIVACY ADDENDUM

 

INTRODUCTION

This GDPR Website Privacy Addendum supplements the information in the our Privacy Policy and applies to personal information/data (“Personal Data”) about individuals located in the European Economic Area.  This GDPR Website Privacy Addendum is in addition to the terms and provisions of our Privacy Policy.

This GDPR Website Privacy Addendum (the “GDPR Website Privacy Addendum”) supplements the information contained in the Fairclose Privacy Policy and applies solely to all Users of our Site and Platform who are located in the European Economic Area. We adopt this GDPR Website Privacy Addendum to comply with the General Data Protection Regulation (2016/679) and any implementing acts of the foregoing by any of the member states of the European Economic Area, the United Kingdom, or Switzerland (“GDPR”) and any terms defined in the GDPR or our Privacy Policy have the same meaning when used in this GDPR Website Privacy Addendum. This GDPR Website Privacy Addendum takes precedence over anything contradictory in our Privacy Policy.

 

DATA CONTROLLER, DATA PROTECTION OFFICER, AND REPRESENTATIVE

FAIRCLOSE is the data controller of the Personal Data you provide on the Site and/or Platform.  FAIRCLOSE is not required to appoint a Data Protection Officer or a representative in the European Union, and has elected not to do so.

 

LAWFUL BASIS FOR PROCESSING YOUR PERSONAL DATA

We have a lawful basis for our processing of your Personal Data, including processing for our legitimate interests (when balanced against your rights and freedoms), to fulfill our obligations to you under a contract with you, and required by law, and with your consent.

If you are in the European Union, the processing of your Personal Data is lawful only if it is permitted under the applicable data protection laws. We have a lawful basis for each of our processing activities (except when an exception applies as described below):

By using our Site and Platform, you consent to our collection, use, and sharing of your Personal Data as described in this Privacy Policy. If you do not consent to this Privacy Policy, please do not use the Site or Platform.

Legitimate Interests.  We will process your Personal Data as necessary for our legitimate interests. To Fulfill Our Obligations to You under our Contract. We process your Personal Data in order to fulfill our obligations to you pursuant to our contract with you to deliver our services to you.

We may also process your Personal Data when we are required or permitted to by law; to comply with government inspections, audits, and other valid requests from government or other public authorities; to respond to legal process such as subpoenas; or as necessary for us to protect our interests or otherwise pursue our legal rights and remedies (for instance, when necessary to prevent or detect fraud, attacks against our network, or other criminal and tortious activities), defend litigation, and manage complaints or claims.

 

SPECIAL CATEGORIES OF INFORMATION

We may process some Personal Data considered sensitive when necessary to carry out our obligations under the law or to protect our legitimate interests.

Some Personal Data processed by FAIRCLOSE may be considered sensitive, including Personal Data that reveals racial or ethnic origin or other Personal Data. To the extent that FAIRCLOSE processes such information, this information is processed only to the extent necessary to carry out its obligations under the law or to the extent necessary to protect FAIRCLOSE’s legitimate interests.

 

AUTOMATED DECISION MAKING

We generally do not use your Personal Data with any automated decision making processes.  FAIRCLOSE does not use your Personal Data with any automated decision making process, including profiling, which may produce a legal effect concerning you or similarly significantly affect you.

 

YOUR RIGHTS REGARDING YOUR INFORMATION AND ACCESSING AND CORRECTING YOUR INFORMATION

You may have certain rights under applicable data protection laws, including the right to access and update your Personal Data, restrict how it is used, transfer certain Personal Data to another controller, withdraw your consent at any time, and the right to have us erase certain Personal Data about you. You also have the right to complain to a supervisory authority about our processing of your Personal Data.

Applicable data protection laws may provide you with certain rights with regards to our processing of your Personal Data.

Access and Update. You can review and change your Personal Data by logging into the Site and Platform and visiting your “Account” page. DATA RETENTION PERIODS

This Privacy Policy for California Residents supplements the information contained in the FAIRCLOSE PRIVACY POLICY and applies solely to all visitors, users, and others who reside in the State of California in the United States ("consumers" or "you") who use our Site. Only you, or someone legally authorized to act on your behalf, may make a request to know or delete related to your personal information.

Response Timing and Format

We endeavor to substantively respond to a verifiable user request within forty-five (45) days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding our receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should reasonably allow you to transmit the information from one entity to another entity.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

 

PERSONAL INFORMATION SALES OPT-OUT AND OPT-IN RIGHTS

However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information's value and contain written terms that describe the program's material aspects.
